Insurance law is a beast of its own for which the legislator has set up its own section in the Dutch Civil Code. This section contains the general rules and obligations that apply to both the insurer and the policyholder. It is essential that you realise which obligations apply to you before taking out an insurance, as it will determine the coverage of your insurance and therefore the extent to which you may recover your losses in the event of damage. For example, your obligation to provide information when completing an application form can have (far-reaching) consequences for the award and amount of compensation. The insurer will usually only assess whether you have fulfilled your obligation to provide information when you submit a claim. Edith Van den Akker is medeauteur van het boek ‘Informatieplichten van dienstverleners’ (1999) en promoveerde in 2001 op haar proefschrift ‘Beroepsaansprakelijkheid ten opzichte van derden’. Van 1998 tot 2003 was zij werkzaam bij Houthoff Buruma te Rotterdam op de secties verzekeringsrecht en bouwrecht. Zij is sinds 2004 verbonden aan Yspeert advocaten. Intern is zij mede verantwoordelijk voor de opleidingen van advocaten en advocaat stagiairs.
